In 2013, the Tenth Circuit Court of Appeals held in Lens.com, Inc. v. 1-800 Contacts, Inc. that online contact lens seller Lens.com did not commit trademark infringement when it purchased search advertisements using competitor 1-800 Contacts' federally registered 1800 CONTACTS trademark as a keyword. In August 2016, the Federal Trade Commission filed an administrative complaint against 1-800 Contacts alleging, among other things, that its trademark enforcement practices in the search engine marketing space have unreasonably restrained competition in violation of the FTC Act. 1-800 Contacts has denied all wrongdoing and is scheduled to appear before an FTC administrative law judge in April 2017.
The monthly volume of searches entered on keywords can be found with a few different methods. If you have a Google AdWords account, you can use Keyword Planner for this step. If you don’t, there are a few free sites out there that will give you similar numbers. Obviously, if a keyword has higher monthly searches you’ll want to keep it in mind. However, that also might mean that it has a higher keyword difficulty, and fiercer competition.
It means that every piece of content that leads searchers to you is extending your brand equity. Not only that, you’re creating multiple touch points, so potential customers have every opportunity to discover your business. It takes on average of 6-8 touch points with a brand before someone becomes “sales-ready.” Too many? Well, for some industries, it’s way more. One woman’s car-buying journey took 900 digital touch points spanning three months.
This all sounds amazing right? unfortunately, organic marketing is also very difficult to implement and resource intensive. Ranking organically on Google and other search engines can be very hard, especially for competitive keywords such as “buy shoes.” Ultimately you want to rank within the first page, and possibly within the top 3 organic results, but this can be next to impossible when you are competing with large companies that have teams dedicated to ranking their keywords.
Every one of those engagements can amplify a post tenfold depending on the size of their network. And really you’re educating them on, ‘Hey, when you engage with our content, you’re not only just liking the content, but you’re opening that content up to all of your network, which can ultimately help with building the business’ bottom line, getting more awareness, which in turn drives more leads, and helps move people down the funnel, they build trust when they see your name more often.’

The site has no penalties or anything - the traffic seems to be growing every week. would you recommend hiring someone to go through the link profile anyway to remove crummy links that just occur naturally?
And then on the flip side with partners, it is a little bit different. Again, you can do that education piece, but ultimately offering reciprocation is going to be your best bet. So finding out who the social media manager is for your partner, talking with them, figuring out, ‘Hey, we’re going to retweet you this many times this month, or is there any events that you have coming up that we can help promote?’ And that reciprocation is very natural. It also builds credibility for both organizations. I think there’s a lot of opportunity to engage with your partners as well as amplify their content.
You could get even more specific by narrowing it down to customer base. Is there a specific group of clients you tend to serve? Try including that in your long-tail key phrase. For example: “SEO agency for non-profits in Albuquerque NM.” That’s a key phrase you’re a lot more likely to rank for. Not to mention it will also attract way more targeted, organic traffic than a broad key phrase like “SEO agency.”
Organic is what people are looking for; the rest of these simply put things in front of people who may or may not be seeking what you offer. We know that approximately X number of people are looking for Y every day. So if we can get on front of those people, we have a much greater opportunity to create long-term relationships and increase our overall ROI.
